In this chapter, unless the context otherwise requires, the following definitions apply:

1. Abstract of vote means a document prepared by a tally board that reflects the number of ballots cast, the number of ballots rejected, the number of votes cast for a candidate, and the number of votes cast for or against a ballot measure in each precinct.

2. Accessible voting device means a device with adaptable technology making it accessible to individuals with disabilities, which a voter uses to electronically record the voter’s choices. The device produces a paper document or ballot that visually indicates the voter’s selections.

3. Accessible voting location means a place designated by the City Clerk at which accessible voting devices are made available.

4. Authorized voting system means a voting system that the Arizona Secretary of State has approved for use in Arizona.

5. Ballot means a paper ballot that is marked and tallied manually, an optical scan ballot that is electronically tabulated, or an electronic ballot cast on an accessible voting device.

6. Ballot box means the container provided for the deposit and security of ballots at all voting locations.

7. Ballot Judge means the Election Official charged with issuing ballots to voters at voting centers.

8. Ballot card means a tabulating card on which votes may be recorded by means of marking.

9. Ballot measure means an initiated or referred proposition on which voters are asked to cast either a "yes" or "no" vote, or a vote of "for" or "against."

10. Ballot report means a document prepared by an election board that shows the number of ballots being forwarded for tabulation.

11. City of Phoenix Register of Voters means the register of qualified electors of the City of Phoenix.

12. City of Phoenix Inactive Voter List means the record of all persons in the City of Phoenix whose names appear on the Maricopa County Inactive Voter List.

13. City precinct means a precinct designated by the City Council, which shall be comprised of one or more Maricopa County Precincts, or portions of Maricopa County Precincts.

14. Condensed abstract of vote means a document that summarizes the abstracts of vote for each precinct.

15. Counting center means one or more locations designated by the City Clerk for the tabulation of ballots.

16. Duplicate ballot means a true copy of a voted ballot that could not be read by the vote tabulating equipment.

17. Duplication Board means a Board appointed to produce duplicate ballots and enhance ballots that cannot be read by the vote tabulating equipment.

18. Early Ballot Board means a Board, consisting of an inspector and two judges, appointed to process early ballots.

19. Election official means the City Clerk, the City Clerk’s designee, and the inspectors, judges, clerks, and other persons appointed to assist with the conduct of an election.

20. Election returns means the official returns; the unofficial returns; all voted early, official, and provisional ballots; all rejected ballots; and other documents used in the processing of ballots.

21. Electioneering means any verbal activity that can be reasonably interpreted as an attempt to persuade or influence a person to vote for or against any candidate or ballot measure.

22. Electronic voting system means a system in which votes are recorded on ballots by means of marking or by direct electronic recording device. The votes are counted and tabulated by accessible voting devices and vote tabulating equipment.

23. Informational Pamphlet means a document for a bond election that contains the number and title of each proposition as it appears in the sample ballot, the text and a summary of each proposition, any arguments filed supporting or opposing each proposition, and the financial and other information required by State Law.

24. Instructions and Procedures Manuals means the manuals prepared by the City Clerk as a guide for the conduct of City elections, including, but not limited to, detailed instructions for the performance of each task relating to the collection of ballots and the counting of votes in a manner that provides maximum security, efficiency, and accuracy.

25. Mail ballot election means an election in which all registered City voters receive a ballot by mail, and in which no polling places or voting centers are used to conduct the election.

26. Manual count means a count of ballots by Tally Boards without the use of electronic vote tabulating equipment.

27. Mark means for a paper ballot, a character or symbol, which is distinguishable and noticeable to a reasonable person, used by a voter to indicate the voter’s choice; or alternatively, for an optical scan ballot, an indicator of a voter’s choice made according to the instructions on the ballot.

28. Official ballot means the ballot containing the names of all candidates for office and the text for each ballot measure, to be used for voting at voting centers.

29. Official early ballot means the ballot containing the same names of all candidates for office and the same text for each ballot measure as the official ballot, to be marked with the word "early" and used for early voting.

30. Official returns means the stubs of voted ballots, if any, and any rejected, invalid, or spoiled ballots.

31. Optical scan ballot means a ballot card that is marked by a voter according to the instructions on the ballot, and that can be counted by vote tabulating equipment.

32. Permanent Early Voting List means the list of Phoenix voters whose names appear on the Maricopa County Permanent Early Voting List.

33. Provisional ballot means a ballot cast in an election that will be counted only after subsequent verification by the City Clerk or Maricopa County Recorder that the voter was eligible to cast the ballot and did not cast a prior ballot in the election.

34. Publicity Pamphlet means a document that contains the number and title of each proposition as it appears in the sample ballot, the text and a summary of each proposition, and any arguments filed supporting or opposing each proposition. The Publicity Pamphlet may contain additional information for voters.

35. Qualified elector means a person who resides in Phoenix, is qualified to register to vote and who is properly registered to vote.

36. Register official means the election official charged with determining whether a person’s name appears in the City of Phoenix Register of Voters or on the City of Phoenix Inactive Voter List prior to the person obtaining a ballot at a voting center or other voting location.

37. Residence means that place in which a person’s habitation is fixed, and to which the person has the intention of returning when absent.

38. Resident means an individual who has actual physical presence in the City of Phoenix, combined with the intent to remain. A temporary absence does not result in a loss of residence if the individual intends to return following the individual’s absence. An individual has only one residence for purposes of this chapter.

39. Roster Judge means the election official charged with the duties of assuring that the name and signature of each person voting at a voting center is placed in the Voting Center Signature Roster and that each voter provides proper identification.

40. Sample ballot means a copy of the official ballot that is distinct in color or marking from the official ballot which, when in pamphlet form, shall be known as the sample ballot pamphlet. The sample ballot pamphlet may contain additional information for voters.

41. Special Board means a Board appointed to receive, process, or tabulate the ballots at the counting center or receiving center. The Board shall consist of two judges and, if necessary, an inspector.

42. Spoiled ballot means a ballot that has been damaged or has been marked in a way that does not reflect the voter’s choice, and has been surrendered by the voter for a new ballot.

43. Substitute ballot means a ballot issued to a voter by an election official in place of the official ballot.

44. Tally Board means a Board, consisting of an inspector and two judges, appointed by the City Clerk to manually count ballots.

45. Tally list means a document used by a Tally Board to record the number of votes cast for each candidate and the number of votes cast for or against each ballot measure.

46. Unofficial returns means the Voting Center Signature Roster, the challenge list, one copy of the ballot report, the voter information slips, and the envelope containing the ballot box key, if any.

47. Vote tabulating equipment means the apparatus necessary to count votes marked on ballots or mark-sensitive paper, and tabulate the results.

48. Voter information slip means the form that is used to provide the person’s name, council district, and other information to election officials so that they may determine whether the person is eligible to vote and for the voter to receive the correct ballot.

49. Voting center means a polling place where any eligible voter who resides within the corporate limits of the City of Phoenix may cast a ballot in a City election.

50. Voting Center Signature Roster means a document that contains the name, other voter information, and signature of each person who votes at a voting center in sequential order of voting.

51. Write-in candidate means a qualified elector who has timely filed the required nomination paper with the City Clerk and whose name appears on the notice of official write-in candidates. (Ord. No. G-5390, § 1, 2009; Ord. No. G-5560, § 1, 2010; Ord. No. G-5737, 2012)
