a. A person whose name is not in the City of Phoenix Register of Voters or on the City of Phoenix Inactive Voter List may present to the Election Board a certificate from the Maricopa County Recorder showing that the person is entitled by law to vote in a precinct within the City. The name, other voter information, and signature of any such person shall be entered on the Voting Center Signature Roster and the person shall be allowed to vote an official ballot.

b. A person whose name is not in the City of Phoenix Register of Voters or on the City of Phoenix Inactive Voter List who resides at an address within the corporate limits of the City of Phoenix and who presents acceptable identification pursuant to State Law shall be allowed to cast a provisional ballot.

c. A person registered in Maricopa County who has moved to a new address in the City during an open registration period and who has not notified the Maricopa County Recorder of the change of address before the date of an election, shall be permitted to correct the person’s voter registration records at any voting center. The person shall be allowed to vote a "New Residence Provisional Ballot" if the person has resided at the new address for at least twenty-nine days immediately preceding the election and if the person does both of the following:

1. Presents to the Election Board acceptable identification pursuant to State Law.

2. Affirms in writing that the person’s new residence is located within the corporate limits of the City of Phoenix.

d. Any person who is listed as having voted and returned an early ballot, but who states and affirms in writing that the person did not vote such ballot, shall be allowed to vote an "Early Voting Provisional Ballot." Before counting the ballot, the City Clerk shall verify that the person did not vote and return an early ballot. If the person did cast an early ballot, the early voting provisional ballot shall not be counted.

e. The procedure when a voter is allowed to vote a provisional ballot shall be as follows:

1. The voter’s name and other voter information shall be entered on a separate page at the end of the Voting Center Signature Roster. Such names shall be numbered consecutively, beginning with the number P-1. The voter shall sign in the space provided.

2. The ballot shall be placed in a separate envelope, the outside of which shall contain the voting center name, the voter’s name, residence address, and if applicable, former name or residence address, and the voter’s voter registration number, if available. The voter shall complete the affidavit on the envelope affirming the provisional ballot and shall sign the envelope.

f. Before counting any provisional ballot, the City Clerk and, if necessary, the Maricopa County Recorder, shall verify that the person who cast the provisional ballot is eligible to vote and did not cast another ballot in the election. If the City Clerk is unable to verify that a voter who cast a provisional ballot is properly registered to vote, the envelope containing the provisional ballot shall not be opened and shall be retained with the official returns. Verified provisional ballots shall be processed using the procedures outlined for processing early ballots.

g. The City Clerk shall verify the identity of voters who have voted provisional ballots in accordance with applicable identification procedures.

h. Ballots cast pursuant to this section shall be verified within two days after the election by the City Clerk or, if necessary, by the Maricopa County Recorder and then processed by the City Clerk prior to the canvass of the vote. (Ord. No. G-5390, § 1, 2009; Ord. No. G-5560, § 1, 2010)
