a. Not less than one hundred twenty days before any City election, the City Clerk shall mail an election notice to all eligible City voters who are included on the Permanent Early Voting List. If the date on which an election is called makes it impractical for the City Clerk to mail the notice by one hundred twenty days before the election, the City Clerk shall mail the notice as soon as practicable after the call of election.

b. The notice shall state the following:

1. The date(s) of the election(s) to which the notice pertains.

2. The date(s) that the voter’s ballot is expected to be mailed.

3. The address where the ballot will be mailed.

c. The notice shall be mailed by non-forwardable mail, return postage prepaid, shall be marked with the statement required by the Postmaster to receive an address correction notification, and shall include a means for the voter to do any of the following:

1. Change the mailing address for the voter’s ballot for the election or elections indicated on the notice.

2. Update the voter’s residence address. Any such update received by the City Clerk shall be forwarded to the Maricopa County Recorder to update the voter’s registration, as appropriate.

3. Request that the voter not be sent a ballot for the election or elections indicated on the notice.

d. If the notice that is mailed to the voter is returned undeliverable by the postal service, the City Clerk shall forward the notice to the Maricopa County Recorder to update the voter’s registration as appropriate. The notice will be processed as if the voter did not wish to receive an early ballot by mail for the election or elections indicated on the notice. If the voter’s address is updated by the Maricopa County Recorder by the twenty-ninth day prior to the election, a ballot shall be mailed to the voter’s new address.

e. The City Clerk shall mail an official early ballot to all eligible City voters included on the Permanent Early Voting List who have not notified the City Clerk prior to forty-five days before the election that they do not wish to receive an early ballot by mail for the election or elections indicated on the notice and whose notice was not returned as undeliverable by the postal service.
