A. Biennial review. The Director will review, not less often than every two years, the wastewater contribution of users and user classes, the total costs of operation and maintenance of the POTW, and the Department’s approved user charge system. The Director may at such time recommend to the City Council a revision in the sewer service charge and user classes to accomplish the following:

1. Maintain a reasonable proportionate distribution of operation and maintenance costs among users and user classes;

2. Generate sufficient revenue to pay the total operation and maintenance costs necessary to the proper operation and maintenance (including replacement) of the POTW; and

3. Apply excess revenues collected from a class of users to the costs of operation and maintenance attributable to that class for the next year and adjust the rate accordingly.

B. Notification of users. Each user will be notified, at least annually, in conjunction with a regular bill, of the user charge rate and that portion of the total charges that are attributable to user charges.

C. Inconsistent agreements. The user charge system set forth in this chapter is applicable to all agreements or contracts between the City and users including industrial users, other municipalities, State or Federal agencies or installations, and the terms of this chapter have precedence over any such agreements or contracts that are inconsistent with the requirements of this chapter.

D. Wastewater treatment byproducts. All revenue from the sale of treatment-related byproducts will be used to offset the cost of operation and maintenance of the POTW. User charges will be proportionally reduced for all users. Total annual revenues received from the sale of a byproduct will be credited to the POTW operation and maintenance cost no later than the fiscal year immediately following their receipt. (Ord.
