A. Definitions:

1. Authorized signer is a designated representative of a company doing business at Phoenix Sky Harbor International Airport and who is authorized to request identification media for company employees.

2. Badge control fee means a fee that is collected from an applicant obtaining an initial Security Identification Display Area (SIDA) badge.

3. Badge fee means a fee charged to an applicant for obtaining an initial, renewal or replacement identification media.

4. Certified air carrier means aircraft operators holding operating certificates under 14 Code of Federal Regulations Part 119 and subject to the security requirements of 49 Code of Federal Regulations Parts 1544 OR 1546.

5. Identification media or media or badge means any credential, card, badge, or other photo identification issued by the Security Badging Office for use at Phoenix Sky Harbor International Airport.

6. Lost or stolen badge fee is a fee charged when an applicant is obtaining a new badge to replace an unexpired lost or stolen badge of the current airport badge series.

7. Restricted area means the secured area and security identification display area, so designated by signs.

8. Secured area means a portion of an airport, specified in the airport security program, in which certain security measures specified in 49 Code of Federal Regulations Part 1542 are implemented and where aircraft operators and foreign air carriers that have a security program under 49 Code of Federal Regulations Parts 1544 or 1546 enplane and deplane passengers and sort and load baggage and any adjacent areas that are not separated by adequate security measures.

9. Security identification display area (SIDA) means a portion of an airport, specified in the airport security program, in which security measures specified in this part are implemented and includes the secured area and may include other areas of the airport.

10. Sterile area means a portion of an airport defined in the airport security program that provides passengers access to boarding aircraft and to which the access generally is controlled by the Transportation Security Administration, or by an aircraft operator under 49 Code of Federal Regulations Part 1544 or a foreign air carrier under 49 Code of Federal Regulations Part 1546, through the screening of persons and property.

B. Airport issued identification media required.

1. Individuals who require access to the restricted or sterile area shall obtain a Security Identification Display Area (SIDA) badge that authorizes their presence in part or all of those areas.

2. Authorized signers are required to obtain an identification media.

C. Application. Identification media shall not be issued until the applicant has completed the application process, met all certifications, and successfully cleared the security threat assessment and criminal history records check. The Aviation Director may waive the application process for government agencies.

*Requires a Transportation Security Administration approval code from a certified air carrier.

E. Fee waiver. The Aviation Director may waive the fees listed in Section 4-22(D) for government agencies and companies contracted to provide services to the Aviation Department.

F. Fee remittance. The City Controller is authorized to remit a portion of any fingerprinting and security threat assessment fee to the agency or company processing the fingerprints or security threat assessment.

G. Badge termination. Badges will terminate automatically when the individual no longer needs access to the restricted, sterile, or designated public areas. The Aviation Director may immediately terminate a badge for any violation of law, federal rule or regulation, or airport rule, or for failing to properly maintain custody or control of the badge.

H. Request for reconsideration. An individual requesting reconsideration of the Aviation Director’s decision to deny or terminate their badge must do so in writing within five business days. The Aviation Director will notify the individual in writing of his decision within five business days after the request for reconsideration is received. (Ord. No. G-4425, § 2, 2002; Ord.
