Competitive sealed bidding may be used when the City desires to award contracts for goods or services based solely on price as set forth in the solicitation.

A. A solicitation in the form of an invitation for bids will be issued by the Procurement Officer when conducting competitive sealed bidding, which solicitation at a minimum must include:

1. Specifications for the goods or services required by the City;

2. Instructions describing the competitive sealed bidding process, bid preparation, submission of bids, the bid evaluation process; and

3. Material terms and conditions to be included in any resulting contract.

B. Except as authorized in this section, each invitation for bids issued in accordance with this section will be available to the public for at least 14 days prior to the solicitation deadline.

C. After submitting its bid, an offeror may correct or withdraw its bid any time before the solicitation deadline.

D. The Procurement Officer may amend an invitation for bid before or after the solicitation deadline. Any amendment must be made available in a manner provided in the invitation for bids to all persons and businesses that received the initial invitation for bids.

E. Bids shall be physically or electronically opened at the time and place designated in the invitation for bids. Bid prices and the name of each offeror will be recorded and made available to the public. All other information within the bids will remain confidential until the procurement file is made available to the public.

F. Late bids will be rejected, except for good cause.

G. The Procurement Officer will facilitate the evaluation of bids in accordance with the instructions set forth in the invitation for bids.

H. The Procurement Officer may cancel the invitation for bids and reject all bids received prior to award of a contract by the City Council.

I. The Procurement Officer shall recommend contract award to the City Council in accordance with this chapter. Contracts will be awarded to the lowest responsive and responsible offeror(s). (Ord. No. G-5953, 2014)
