Except as otherwise required by law or permitted by this article, all revenue contracts will be awarded as a best value procurement using a revenue contract solicitation that may include an individual factor, or a combination of factors, including revenue and factors other than revenue.

A. The revenue contract solicitation shall include the following:

1. Specifications;

2. Instructions describing the procurement process, response preparation, submission of response, the response evaluation process, including any applicable discussions, short-listing process, use of an evaluation panel, or respondent interviews;

3. Identification of any documentation necessary to determine if the response is responsive;

4. If appropriate, minimum requirements necessary to consider the response, which may include minimum qualifications, minimum revenues or monetary guarantees;

5. If appropriate, response guarantee requirements;

6. Evaluation criteria; and

7. Material terms and conditions to be included in any resulting contract.

B. Except as authorized in this article, each revenue contract solicitation will be available to the public for at least 14 days prior to the solicitation deadline.

C. A respondent may correct or withdraw its response any time before the solicitation deadline.

D. The Procurement Officer may amend a revenue contract solicitation before or after the solicitation deadline. Except as provided in Section 43-39, any amendment must be made available in a manner provided in the revenue contract solicitation to all persons and businesses that received the initial revenue contract solicitation.

E. After the solicitation deadline, a list of respondents that submitted responses will be made available.

F. Late responses shall be rejected, except for good cause.

G. The Procurement Officer shall facilitate the evaluation of all responsive responses in accordance with the instructions and other criteria set forth in the revenue contract solicitation.

H. The Procurement Officer may cancel the revenue contract solicitation and reject all responses received prior to award of a contract by the City Council.

I. If a revenue contract solicitation so provides, the Procurement Officer may hold discussions based on an evaluation panel’s review. Discussions must be conducted in writing or conducted orally and confirmed in writing. In conducting discussions, the Procurement Officer may not disclose any information derived from responses submitted by competing respondents. The Procurement Officer may request response revisions from all respondents with whom discussions were held. The Procurement Officer will facilitate the evaluation of any revisions in the revised responses resulting from the discussions.

J. The City may also negotiate with respondents if the negotiation process is permitted in the revenue contract solicitation. At the end of the applicable evaluation process, the Procurement Officer shall rank the respondents based on the evaluation criteria set forth in the solicitation and enter into negotiations with the highest ranked respondent. If negotiations between the City and the highest ranked respondent are unsuccessful, then the City reserves the right to engage in negotiations with the next highest ranked respondent. This process of negotiating with each respondent beginning with the highest ranked respondent may be followed until the negotiations are successful or the revenue contract solicitation is cancelled. In conducting negotiations, the Procurement Officer will not disclose any information derived from responses submitted by competing respondents.

K. The Procurement Officer may recommend to City Council that one or more respondents be awarded a contract resulting from the revenue contract solicitation. Such recommendation shall be to award the contract to the responsible respondent(s) whose response(s) is determined to represent the best value to the City, taking into consideration any evaluation criteria set forth in the revenue contract solicitation.
