Qualifications based selection may be used when the City desires to award contracts for goods or services based on evaluation criteria other than price as set forth in the solicitation.

A. A solicitation in the form of a request for qualifications will be issued by the Procurement Officer when conducting qualification based selection, which solicitation at a minimum must include:

1. A description of the goods or services required by the City;

2. Instructions describing the qualifications based selection process, statement of qualifications preparation, submission of statements of qualifications, and the evaluation process, including whether the Procurement Officer intends to award a one-time contract or establish a vendor list to award multiple contracts;

3. Evaluation criteria; and

4. Material terms and conditions to be included in any resulting contract.

B. Except as authorized in this section, each request for qualifications issued in accordance with this section will be available to the public for at least 14 days prior to the solicitation deadline.

C. After submitting its statement of qualifications, an offeror may correct or withdraw its statement of qualifications any time before the solicitation deadline.

D. The Procurement Officer may amend a request for qualifications before or after the solicitation deadline. Any amendment will be made available, in the manner provided in the request for qualifications, to all persons and businesses that received the initial request for qualifications.

E. Statements of qualifications shall be physically or electronically opened at the time and place designated in the request for qualifications. The name of each offeror shall be recorded and made available to the public. All other information within statements of qualifications will remain confidential until the procurement file is made available to the public.

F. Late statements of qualifications will be rejected, except for good cause.

G. The Procurement Officer shall facilitate the evaluation of statements of qualification in accordance with the instructions and evaluation criteria set forth in the request for qualifications. Only the evaluation criteria set forth in the request for qualifications will be used in the evaluation process.

H. When a request for qualifications is issued for a one-time contract, at the end of the evaluation process, the Procurement Officer will rank the offerors in order of most to least qualified based on the evaluation criteria set forth in the request for qualifications and enter into negotiations with the most highly ranked offeror in accordance with regulations. When a request for qualifications is intended to be used to award multiple contracts over time, the Procurement Officer may maintain a list of the qualified offerors for a period of time identified in the request for qualifications. While the list remains in effect, the Procurement Officer may request proposals for projects within the scope of the request for qualifications from at least three of the listed offerors, facilitate review of the proposals and enter into discussions in the manner described in Section 43-14(H).

I. The Procurement Officer may cancel the request for qualifications and reject all statements of qualifications received prior to award of a contract by the City Council.

J. The Procurement Officer will recommend contract award to City Council in accordance with this chapter. Contracts will be awarded to the most highly qualified and responsible offerors, taking into consideration the evaluation criteria set forth in the request for qualifications. (Ord. No. G-5953, 2014)
